Summary:

The New York State Department of Financial Services implemented cybersecurity regulations effective March 1, 2017 with provisions to be enforced at different points over a two-year implementation period. The final regulation requires banks, insurance companies, and other financial services institutions regulated by the NY Department of Financial Services to establish and maintain a cybersecurity program designed to protect consumers' private data and important company proprietary data and ensure the safety and soundness of the industry.

The first annual certification by covered entities was due on February 15, 2018. A number of provisions of this regulation have upcoming implementation compliance dates. We will review where we are with the NY DFS implementation timeline, provide guidance on how to meet the upcoming requirements based on that timeline and review additional clarification information released by NY DFS after the initial regulation was issued. We will also take a look at other regulations and guidelines that have been proposed or released that are based to some degree on the NY DFS model.

Objectives:
Attendees can expect to understand:
  • What is in force and yet to come from the regulation phased timeline
  • Which provisions are coming up on the timeline and how to approach meeting those requirements
  • Review additional clarifying information released by NY DFS regarding this regulation
  • Similar proposed regulations and guidelines that are being considered at the state and federal level

  • Shawn H. Malone, Founder & CEO, Security Diligence, LLC
  • James T. Shreve, Counsel, Buckley Sandler LLP
